Business Report writes that Solidarity, emboldened by its recent Constitutional Court victory against the employment equity plan of the Department of Correctional Services (DCS), intends to challenge the contentious Mining Charter draft.
The union has raised concerns over aspects of the Department of Mineral Resources’ draft, which requires 26% black ownership of mining rights and that 2% of a company’s jobs be filled by black disabled workers. Solidarity’s Gideon du Plessis claimed on Monday that such proposals contravened the Employment Equity Act, as they relied on national racial demographics as guidelines for appointments. This is the same argument the union used to win the DCS case. The charter was released by Mineral Resources Minister Mosebenzi Zwane in April. Stakeholder consultations are currently under way.
