BL Premium reports that former Eskom CEO Brian Molefe could pay back less than the R10m the courts ordered him to return to the state-owned power utility’s pension fund.
Confirming that Molefe had yet to repay the money, the Eskom Pension and Provident Fund (EPPF) said it has applied to the high court for an order that would enforce the previous judgment, but with set-offs. Molefe previously advised that he was paid R7m from the fund, and that he had contributed R4.2m, which he brought with him from his days as Transnet group CEO. The EPPF on Wednesday said it would ask the court for an order enforcing the earlier judgment by setting off the amounts owed by Molefe against the money he transferred from the Transnet Retirement Fund. The fund wants the court to then direct Molefe to repay the EPPF the balance that remains after the set-off. The fund is also seeking an order directing Sars to refund all taxes paid to it by the fund as a result of Molefe’s retirement.” Molefe, one of the people accused of bringing Eskom to its knees through the state-capture project, was awarded millions of rand in an early retirement pension benefit after he resigned from Eskom in 2016. Trade union Solidarity, which initiated the case to have Molefe pay back the pension money, expressed concern that it had not been included in the latest court application and urged the EPPF to take the necessary steps to ensure Molefe complied with the original court order.
