BusinessLive reports that the court application by the National Union of Metalworkers of SA (Numsa) and the SA Cabin Crew Association (Sacca) to stop the retrenchment of employees by the SA Airways (SAA) business rescue practitioners (BRPs) will be heard in the labour court on Thursday.
The unions, which in coalition are the majority union, want the retrenchment notices that were sent to employees declared unlawful because the plan to rescue the airline has still not been seen by the unions concerned. Alternatively, the unions want the issuing of the notices to be declared unfair. The BRPs are opposing the urgent application. SAA, was placed in business rescue on 5 December. Unions have until Friday to accept the severance offer and individuals have until 11 May to do so. Should they fail to agree, the BRPs can unilaterally retrench them. The terms of the offer have not been made public, but employees will only get any money after the disposal of assets has taken place to fund the retrenchment packages. About 10,000 employees across the SAA group — including Mango, SAA Technical and Air Chefs — stand to lose their jobs. But, Public Enterprises Minister Pravin Gordhan has begun a parallel process to the business rescue process with trade union representatives, and has brokered an accord that will see some employees rehired in a new airline, should it turn out to be feasible.
