The Constitutional Court in Johannesburg will tomorrow give its ruling on rescinding the Department of Justice’s appointment policy as it pertains to liquidators.

This comes after the Supreme Court of Appeal on 2 December 2016 ruled in favour of Solidarity in this matter, after which the Department of Justice resorted to the Constitutional Court.

Solidarity contends that the Department’s appointment policy amounts to inadmissible and unconstitutional quotas which the Employment Equity Act prohibits. “This approach is a race-obsessed one in contrast to a more inclusive and nuanced approach based on merit and training which can be followed,” Anton van der Bijl, Head of Solidarity’s Labour Law Division said.
